Kirk was born in Fargo, North Dakota, on April 5, 1957. He received his B.S. in Business Administration from Colorado State University in 1980 and his Juris Doctor Degree from the University of Montana in 1989, with High Honors. He began his law practice the same year.  His practice includes litigation, environmental law, real estate, commercial law, probate administration and estate planning.

Kirk's interest in flyfishing led to his extensive involvement in conservation organizations. He served on the Board of Trustees of National Trout Unlimited for several years and is currently Chair of the Montana Council of Trout Unlimited. He is married to Beth Evenson who owns Planet Earth, a local retail store specializing in natural fiber clothing and body products.
